O Superior Tribunal de Justiça (STJ) retoma os julgamentos no segundo semestre com temas com impacto econômico e social e a escolha de novos ministros do tribunal.
Entre as pautas previstas estão os casos do jogador Robinho, do incêndio na Boate Kiss e do pedreiro Amarildo, além de recursos envolvendo planos de saúde e ações sobre o plantio de cannabis para fins medicinais.
O STJ abre o semestre com uma sessão da Corte Especial nesta terça-feira (1º), às 14h. O colegiado conta com os 15 ministros mais antigos do tribunal.
Na pauta, a retomada de um recurso com repercussão para a economia – a discussão sobre o índice que pode ser usado para corrigir dívidas civis como, por exemplo, a indenização por danos morais.
De um lado, está a possibilidade de usar a Selic – a taxa básica de juros da economia – para corrigir esses débitos; de outro, a soma de correção monetária e juros de mora.
Ao longo da análise do caso, os advogados das partes afirmaram que uma decisão sobre o tema tem potencial para afetar mais de 6 milhões de processos no Brasil.
O caso concreto que dá base à discussão no STJ envolve a atualização do valor de uma indenização por danos morais de R$ 20 mil.
Em março deste ano, em uma das sessões de julgamento, o relator do caso, ministro Luís Felipe Salomão, apontou uma diferença de 37% no valor do montante a ser pago a depender do critério a ser usado.
Caso Robinho
No dia seguinte, a Corte Especial volta a se reunir. O colegiado retoma a análise do pedido da defesa do jogador Robinho para que o governo italiano envie ao Brasil a íntegra, traduzida para o português, do processo que o condenou a 9 anos de prisão por estupro.
A ação que tramita no tribunal discute a possibilidade de validação da sentença da Justiça italiana, o que permitiria que a execução da pena pelo crime fosse realizada no Brasil.
O ministro relator da ação, Francisco Falcão, negou o pedido de tradução e os advogados do ex-jogador recorreram ao plenário da Corte Especial. No início do julgamento, em abril, um pedido de vista do ministro João Otávio de Noronha suspendeu a deliberação.
Boate Kiss
Ainda neste semestre, em data a confirmar, a Sexta Turma do STJ deverá retomar o julgamento do recurso contra a anulação do júri que condenou os quatro acusados pela tragédia da Boate Kiss, em Santa Maria (RS).
Em 13 de junho, no começo do julgamento, o relator, ministro Rogerio Schietti Cruz, para restabelecer o júri popular, mas um pedido de vista dos ministros Sebastião Reis Junior e Antonio Saldanha Palheiro.
Escolhas de ministros
O STJ conta com três vagas de ministro a serem preenchidas – duas relativas às aposentadorias dos ministros Felix Fischer e Jorge Mussi e outra por conta da morte do ministro Paulo de Tarso Sanseverino.
Duas destas vagas serão preenchidas a partir da formação de uma lista de quatro nomes, a ser formada no dia 23 de agosto. O plenário do tribunal vai analisar os nomes dos desembargadores enviados pelos Tribunais de Justiça estaduais e enviar a lista ao presidente Lula.
O tribunal também vai preencher a terceira vaga com uma lista a ser feita com nomes enviados pela Ordem dos Advogados do Brasil. A OAB elabora uma lista com seis nomes e o tribunal envia ao presidente Lula uma relação com seis nomes.
O STJ é formado por 33 ministros. Destes, um terço é escolhido entre desembargadores federais, um terço entre desembargadores de justiça e mais um terço entre advogados e integrantes do Ministério Público.

2 de agosto, Corte Especial: análise de uma ação do Ministério Público Federal contra uma decisão que que permitiu o início das obras de expansão da Linha 2 do metrô de São Paulo, conhecida como Linha Verde;
3 de agosto, Terceira Seção: recursos que discutem o enquadramento de crimes previstos no Estatuto da Criança e do Adolescente para a prática de compartilhamento e de armazenamento de imagens de pornografia infantil;
8 de agosto, Quarta Turma: recurso que discute a indenização por danos morais por conta de tortura que teria sido praticada pelo coronel do Exército Carlos Alberto Brilhante Ustra contra o jornalista Luiz Eduardo da Rocha Merlino, na sede do DOI-Codi, em São Paulo, durante a ditadura militar;
9 de agosto, Segunda Seção: recurso discute se planos de saúde devem custear cirurgias plásticas em pacientes que passaram por cirurgia bariátrica;
22 de agosto, Sexta Turma: sete recursos sobre o desaparecimento do pedreiro Amarildo Dias de Souza em 2013. Amarildo teria sido levado por policiais militares para a Unidade de Polícia Pacificadora (UPP) na comunidade da Rocinha e, segundo as investigações, teria sido torturado até a morte. Os recursos são de policiais condenados e do Ministério Público do Rio.
Ainda sem data, Terceira Seção: ministros vão discutir pedidos individuais de salvo-conduto para o cultivo doméstico da Cannabis sativa (maconha) com fins medicinais. Em decisões individuais, ministros têm concedido a autorização para o cultivo da planta sem que isso leve a consequências penais na Justiça. Agora, a Terceira Seção – que reúne ministros das duas turmas que julgam casos penais – vai uniformizar o entendimento.
